Welcome to Tutube ("the App," "we," "our," or "us"). These Terms of Use ("Terms") govern your use of our mobile application and services. By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using Tutube, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and the App.

3. User Content and Conduct

3.1 Your Creations

You retain rights to your preferences. The birthday you enter is used only on your device to determine your zodiac sign and is never uploaded to our servers, stored, or analyzed. The AI-generated music and cover art are provided for your personal use according to these Terms.

3.2 Acceptable Use

You agree to use the App responsibly and not to:

• Use the App in any way that infringes the rights of others
• Generate content that infringes on intellectual property rights
• Create offensive, harmful, or inappropriate content
• Use the App to harass, abuse, or harm others
• Interfere with or disrupt the App's operation
• Attempt to bypass any technical limitations
• Use generated content for commercial purposes without proper licensing

4. Intellectual Property Rights

4.1 App Ownership

The App and its original content, features, and functionality are and will remain the exclusive property of Tutube and its licensors. The App is protected by copyright, trademark, and other intellectual property laws.

4.2 Generated Content

AI-generated music created through the App:

• Is provided for personal, non-commercial use
• May not be unique or exclusive to you
• Should be used in compliance with all applicable laws
• May require additional licensing for commercial use

5. Third-Party Services

The App integrates with third-party services for functionality:

• Replicate API for AI music generation
• Cloudflare AI for enhanced processing capabilities
• Apple services for app distribution

Your use of these services is subject to their respective terms and policies.

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your information.

7. Disclaimers and Limitations

7.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• AI-generated content will meet your expectations
• Generated music will be unique or original
• The App will be free from security vulnerabilities

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.

8. Indemnification

You agree to indemnify and hold harmless Tutube, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Termination

9.1 Your Right to Terminate

You may stop using the App at any time by deleting it from your device.

9.2 Our Right to Terminate

We may suspend or terminate your access to the App immediately if you breach these Terms or for any other reason at our discretion.

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination will remain in effect.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the App or other means. Continued use after changes indicates acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. You agree to submit to the jurisdiction of courts in California.

12. Dispute Resolution

12.1 Informal Resolution

Before formal proceedings, you agree to attempt informal dispute resolution by contacting us at support@tunely.app.

12.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

13. General Provisions

13.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Tutube.

13.2 Severability

If any provision is found invalid, the remaining provisions continue in full force.

13.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

13.4 Assignment

You may not assign these Terms without our consent. We may assign our rights without restriction.

• Apple has no obligation to provide maintenance or support
• Apple is not responsible for addressing any claims about the App
